The UK has been fortunate enough to experience a number of property booms in recent years and this has seen some residential properties double or even triple in value. This appears to have triggered a number of divorcees going back to court in search of a more lucrative settlement. In fact, according to new High Court figures, the numbers of divorcees wanting to relook at the original settlement has doubled in a year.
As the economy bounces back, so do share prices and this has led to people wanting a more generous pay out many years after the original split. A well-publicised example of this is Ecotricity Limited founder Dale Vince, whose ex-wife is claiming for maintenance 20 years after they divorced. This year the Supreme Court granted his wife the go-ahead to bring a claim for financial support because there is no time limit for spouses to make a claim for financial provision.
Since 2011, the number of cases involving divorcees seeking a better deal from their former spouse has risen eightfold. If the value of assets divided up by couples originally, when the economy was not doing so well, goes up, then ex partners can make a claim if the agreements was never formalised by a court order.
Assets such as pensions and shares which didn’t seem worth fighting over are now worth a revisit.
