If you are on certain benefits, you may qualify for legal aid funding. If not, we may be able to assist you.
Domestic abuse can come in many forms and includes behaviour that can be controlling, coercive and manipulating. It is not limited to actual physical abuse but extends to, psychological, sexual, emotional and financial abuse.
We can offer advice and we can explain the steps available to you. We can help you through the process should it be necessary to apply to the court for an order.
There are different types of orders available;
A “non-molestation order” with its aim to prohibit a person from doing a specific act (eg not to use violence, threaten violence or intimidate). This can be dealt with as an emergency remedy. It may not stop the abuse but any breach of the Order by the abuser can result in them be arrested after a report to the police.
An “Occupation order” can enable you to stay in your home to the exclusion of the abuser. This would be dealt with by the court on notice.
Typically these orders last for 6 to 12 months. They can also be renewed and extended if the behaviour continues.
You should also consider calling the Police if you are being abused in any way as they also have powers to deal with these issues.
There are also agencies to support you such as a 24 hour National Domestic Violence Helpline.
You may have been served with such an application/order and wish to seek advice on how to proceed.
