In April 2007 a mother experienced her worse nightmare when a ‘traumatic’ birth led to complications for her baby daughter whose brain was starved of oxygen. Her baby sustained severe brain damage as a result of the lack of oxygen and an investigation, into the events leading up to and including the birth, found NHS Trust staff to be negligent.
The girl, who is now eight, is totally immobile and dependent on being fed through a tube. She also suffers muscle spasms which are very painful and cause extreme stress for many hours. She is at risk of hypothermia due to her being unable to control her body temperature and needs 24 hour care.
The huge settlement includes an index-linked amount starting at £225,000 and rising to £290,000 when she turns 18 and a £295,000 lump sum he girls pain, suffering and disability. The compensation includes £1.6m to buy a family home with some of the settlement being used to install a hydrotherapy pool in the home to soothe her muscle spasms.
The Trust’s medical director said: “We are very sorry for the harm caused to …. and the distress caused to her family as a result of the issues arising from her birth.
“The injuries she suffered are very severe and a tragedy for her and her family. Her parents have had to cope with extraordinary pressures in looking after her.”
