Collaborative family law offers a constructive alternative to the traditional court process, placing families firmly at the centre of decision-making and encouraging a more cooperative approach to resolving disputes.
Collaborative law is a form of non-court dispute resolution where each party instructs their own collaboratively trained solicitor and all discussions take place in a series of “four-way” meetings. These involve both clients and their lawyers working together to reach agreement face-to-face.
The process is underpinned by a shared commitment: all participants sign an agreement confirming they will work towards a resolution without going to court. This creates a focused, solution-driven environment where the emphasis is on cooperation rather than conflict.
Where appropriate, other professionals such as financial advisers, pension actuaries and tax experts can be brought into the process to support informed and well-rounded outcomes for the whole family.
